Payment Authorization Terms and Conditions

By using the online payment option, you (hereafter "User," "you" or "your"), you are confirming that you accept the Terms and Conditions and agree that by scheduling a one-time payment via online payment (“Payment”), you authorize your financial institution and The Menninger Clinic to initiate debit(s), credit(s) or correction entries for such payments from your account (“Payment Account”). You promise that you have all necessary rights, power and authority to authorize each such payment and that you will take such steps as your financial institution may require to make such authorization. The Payment is directly authorized by User based upon accurate information provided to Company by User.

NOTICE

In order to use the online payment option, all Users must register and are required by The Menninger Clinic to adhere to the following Terms and Conditions. Please read the Terms and Conditions carefully. The Terms and Conditions are applicable in addition to The Menninger Clinic Privacy Policies and Procedures, Website Disclaimers, and any other documents in effect that govern your relationship with The Menninger Clinic.

The Menninger Clinic may amend or change the Terms and Conditions of Use from time to time, at its sole discretion. Please review the Terms and Conditions of Use prior to making any Payment and prior to updating your account information. By authorizing a Payment to The Menninger Clinic, you expressly acknowledge and accept the Terms and Conditions. If you do not agree to be bound by the Terms and Conditions, you cannot use the online payment option.

USER LIABILITY & OBLIGATIONS

If you believe a Payment was made from your Payment Account without your permission, you are required to contact The Menninger Clinic within two business days after you learn of the unauthorized Payment. Your failure to notify The Menninger Clinic within this time frame may increase your liability for the unauthorized Payment.

If, after reviewing your Payment Account statement, you discover an unauthorized Payment, you must notify The Menninger Clinic within 60 days after the statement was mailed to you. Your failure to notify The Menninger Clinic within 60 days may increase your liability to the full amount of the Payment.

YOU    ARE    RESPONSIBLE    FOR    TIMELY    PAYMENT    ON    YOUR     ACCOUNT,

REGARDLESS    OF    YOUR     METHOD    OF    PAYMENT.     IT    IS    SOLELY     YOUR

RESPONSIBILITY TO MONITOR YOUR ACCOUNT AND YOUR PAYMENT ACCOUNT(S) IN ORDER TO ENSURE TIMELY PAYMENT IS MADE.

You agree to participate in the security features of the site and to protect your sensitive information from unauthorized individuals. YOU AGREE THAT THE USE OF SECURITY FEATURES SUCH AS A USER ID AND PASSWORD OR OTHER SECURITY CODE CONSTITUTE COMMERCIALLY REASONABLE SECURITY PROCEDURES FOR ACCESS TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, INITIATING OR AUTHORIZING PAYMENTS, AND ARE INTENDED TO VERIFY THE AUTHENTICITY OF THE TRANSACTION AND NOT FOR THE PURPOSE OF DETECTING ERRORS. 

You agree not to use service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, or obscene or that infringes on the rights of others. You shall not upload or transmit viruses or malicious code. You agree not to use Service to do anything unlawful, misleading, malicious, or discriminatory. 

TERMINATION OF USE

Your access to the online payment option may be immediately suspended by The Menninger Clinic if: (1) you do not agree to the Terms and Conditions; (2) your use at any time violates the Terms and Conditions; or (3) your use results in 3 or more payments being returned due to non-sufficient or insufficient funds, cancellation, stop-payment, or any similar designation.

We may restrict your access to the site without notice in certain situations; for example, if you are out of the country.

CONFIDENTIALITY

The Menninger Clinic will disclose to third parties the information you provide about your Payment Account(s), Payment(s) you authorize and for online payments under the following circumstances: (1) to support services you have requested, (2) to comply with criminal justice agencies' requests, subpoenas, lawful discovery under federal or state rules of civil and criminal procedure or court orders, and (3) if you give The Menninger Clinic written permission to do so.

DISCLAIMER OF LIABILITY

The Menninger Clinic will not be liable for any losses or damages you may incur if: (1) you do not have enough money in your Payment Account to make a Payment; (2) circumstances beyond The Menninger Clinic’s control, including but not limited to, natural disaster, flood, earthquake, fire, war, act of terrorism, or acts of third parties in violation of federal, state, or international law, render The Menninger Clinic unable to effectuate the Payment despite reasonable precautions under the circumstances; or (3) you provide erroneous information to authorize the Payment.

While The Menninger Clinic has adopted reasonable methods to ensure that you have entered your Payment Account information appropriately, The Menninger Clinic is in no way responsible for your submission of erroneous information and will accept as true and accurate the information you provide. The Menninger Clinic assumes no responsibility for verifying the information you provide if, through no fault of The Menninger Clinic, the financial institution that holds your Payment Account fails to effectuate a Payment, commits any errors during the Payment in any form whatsoever, or provides The Menninger Clinic erroneous information.

Completion of a Payment is contingent upon both authorization by the applicable financial institution and acceptance of your Payment by The Menninger Clinic. In the event that The Menninger Clinic is unable to process your Payment, The Menninger Clinic will attempt to notify you at least once using the contact information contained in The Menninger Clinic’s records. Except as provided in the Terms and Conditions, The Menninger Clinic will not be responsible for incomplete or late Payments and will not extend credit under such circumstances.

THE MENNINGER CLINIC IS NOT RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGE RELATED TO YOUR USE OF THE ONLINE PAYMENT OPTION.

The Terms and Conditions are entered into in the state of Texas and will be governed by and construed in accordance with the laws of the state of Texas.

The Menninger Clinic is under no obligation to provide any online payment option and may modify or revoke access to or discontinue the service at any time without notice.
